Acceptable Use & Communications Policy

APAI LLC · Effective October 1, 2026 · How you may and may not use the contact data — the rules that keep you lawful.

Why this policy exists

The service gives you tools to research property owners and obtain their contact information. Whether contacting those people is lawful depends on facts only you know: whether the number is on a do-not-call register, whether you have consent or a valid exemption, what you say, and how many times you say it.

This policy is part of the Terms of Service. It exists to make the division of responsibility unmistakable.

You — not APAI LLC — decide who to contact, what to say, and when. We do not make calls or send messages for you, we do not screen numbers against do-not-call registers, and we do not provide legal or compliance clearance for any contact you make.

1. Compliance with telemarketing and privacy law is your responsibility

You are solely responsible for complying with all laws that apply to your outreach, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the National Do Not Call Registry rules, state mini-TCPA and do-not-call statutes, state privacy laws, and any licensing rules that apply to your business.

This includes obtaining any consent required before you call or text; honouring do-not-call requests and internal do-not-call lists; identifying yourself and your business; honouring opt-out requests promptly; observing calling-time restrictions; and keeping your own records proving consent and compliance.

2. Specific prohibitions

You must not use the service, or information obtained from it, to:

  • Make or send any call, text, or message that is unlawful, including robocalls or automated texts without the consent the law requires.
  • Contact a person who has asked you not to be contacted, including anyone on a do-not-call register where no exemption applies.
  • Harass, threaten, intimidate, defame, or repeatedly contact someone after they have asked you to stop.
  • Misrepresent who you are, that you are the property owner's lender or servicer, or that you have a relationship with them that you do not have.
  • Engage in unlawful discrimination, including targeting or excluding people on the basis of race, color, religion, sex, familial status, national origin, disability, or any other protected characteristic. Fair-housing law applies to real-estate marketing.
  • Obtain or use information about a person for an unlawful purpose, including stalking, domestic violence, identity theft, or debt-collection practices that violate the law.
  • Violate the Driver's Privacy Protection Act, the Gramm-Leach-Bliley Act, or the Fair Credit Reporting Act, including using skip-trace information for eligibility purposes (credit, employment, insurance, or tenant screening) for which it is not furnished.
  • Publish, resell, rent, redistribute, sublicense, or post publicly any skip-trace data, or make it available to any third party, including on a public website, forum, or spreadsheet-sharing link.
  • Use skip-trace data to build, train, or improve a competing database or machine-learning model, or to verify or enrich another data source.
  • Scrape, crawl, or bulk-extract the service beyond the features and limits we provide, or to circumvent rate limits, plan limits, or authentication.
  • Gain unauthorized access to any account, system, or network, or probe, scan, or test the vulnerability of the service.
  • Upload or transmit malware, or content you do not have the right to use.
  • Impersonate another customer, share your login, or resell access to the service.

3. Text messages and calls — extra care

  • Consent standards for marketing texts are strict, and statutory damages are per message. If you do not have documented consent, do not send marketing texts.
  • A phone number in our data is not a representation that the number belongs to the person you are trying to reach, that it is not a reassigned number, or that it is not on a do-not-call register.
  • Wireless numbers are not identifiable as such from the data we return, and numbers are reassigned constantly.
  • Record your consent, your call and message logs, your do-not-call requests, and your opt-outs. Keep them for at least five years.

4. Enforcement

We may investigate suspected breaches. We may suspend or terminate your access immediately, without refund, if we reasonably believe you have breached this policy, if a data provider, payment network, carrier, or regulator raises a concern about your use, or if continuing to serve you exposes us to legal or regulatory risk.

We may report unlawful activity, and we may preserve and disclose records relating to your use in response to valid legal process.

We would rather help you stay compliant than cut you off. If you are unsure whether a campaign is lawful, ask us at support@wholesaleos.shop before you run it.

5. Reporting misuse

If you believe someone is using WholesaleOS to break the law or to harass people, tell us at support@wholesaleos.shop and we will act on it.
